File Tax Return


Who should File Tax Return?

PersonFiling return of income is mandatory

A company or Firm

Irrespective of whether they earn income or loss.

A person (other than company or firm)

When they have Taxable total Income.

Every person, being an Individual, or a HUF, or an AOP or BOI (whether incorporated or not), or an AJP

When they have Taxable total Income before giving exemption under sections 10A, 10B or 10BA or deductions under Chapter VI-A.

Any person

Who has incurred loss under the head 'Profits and Gains of Business of Profession' or 'Capital Gains' in the previous year and claims that the loss should be carried forward under -

  • Section 72(1) - Business Losses

  • Section 73(2) - Speculation Business Losses

  • Section 74(1) - Capital Loss

  • Section 74A(3) - Activity of Owning and Maintaining Race Horses.

Every charitable or religious trust/institution

When they have Taxable total Income before claiming exemption under sections 11 or 12.

Every political party

When they have Taxable total Income before claiming exemption under section 13A.

Every Trust, Institution, Agency, etc

When they have Taxable total Income before claiming exemption under sections .

  • Section 10(21) - Scientific Research Association.

  • Section 10(22B) - News Agency.

  • Section 10(23A) - Trade or Professional Associations/Institutions.

  • Section 10(23B) - Trust/Society for promotion of Khadi/Village Industries.

  • Section 10(23C) - Trusts/Institutions notified under sub-clauses (iv) or (v) thereof, an Education Institutions under sub-clause (vi) thereof or a Hospital under sub-clause (via) thereof.

  • Section 10(24) - Trade Union/Associations.

Note:

Taxable total Income: -

Resident Individuals, being Senior Citizens (i.e., above the age of 65 Years)

Above Rs.1,95,000

Resident Individuals, being Women assessees below 65 years of age

Above Rs.1,45,000

Others

Above Rs.1,10,000
